By accessing and using the Zarephionix platform and services (collectively, the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Use, please do not use the Service.
Zarephionix reserves the right to update, change, or replace any part of these Terms of Use by posting updates on our website. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
2. Description of Service
Zarephionix provides an online educational platform offering masterclasses, tutorials, demonstrations, and related educational content. The Service includes access to video content, downloadable materials, interactive features, and community forums as available.
We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
3. Account Registration and Security
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Zarephionix and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
All educational content, including but not limited to videos, text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Zarephionix or its content suppliers and is protected by international copyright laws.
6. User Content and License
The Service may allow you to submit, upload, publish, or otherwise make available content including comments, feedback, suggestions, and other materials (collectively, "User Content").
You retain all ownership rights in your User Content. However, by submitting User Content to the Service, you grant Zarephionix a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and Zarephionix's business.
You represent and warrant that you own or control all rights in and to the User Content and have the right to grant the license granted above, and that all of your User Content complies with these Terms of Use.
7. Subscription and Payment Terms
Certain aspects of the Service may be provided for a fee or other charge. You agree to pay all fees and charges associated with your account in accordance with the pricing and payment terms presented to you for that Service.
Subscription fees are billed in advance on a recurring basis depending on the type of subscription plan you select. You authorize us to charge the payment method on file for any such fees.
All fees are non-refundable except as expressly set forth in our refund policy or as required by law. We reserve the right to change our pricing at any time upon reasonable notice to you.
8. Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting our support team at info@zarephionix.com. Cancellations will be effective at the end of the current billing period.
Refund requests for courses or masterclasses may be considered within fourteen days of purchase if you have accessed less than twenty percent of the course content. Refunds are issued at our sole discretion and are subject to our refund policy.
9. Prohibited Uses
In addition to the restrictions outlined in the User Conduct section, you may not use the Service to:
Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
Use any automated system, including but not limited to robots, spiders, or offline readers, to access the Service in a manner that sends more request messages to our servers than a human could reasonably produce in the same period.
Collect or harvest any personally identifiable information from the Service without consent.
Use the Service for any commercial purpose or for the benefit of any third party except as explicitly permitted by these Terms of Use.
10. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by Zarephionix. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that Zarephionix shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Zarephionix does not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Zarephionix, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Our total liability to you for all claims arising out of or related to these Terms of Use or the Service shall not exceed the amount you paid to Zarephionix in the twelve months preceding the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Zarephionix and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Use or your use of the Service.
14. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
15. Copyright Infringement Claims
We respect the intellectual property rights of others. 16. Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
17. Governing Law and Dispute Resolution
These Terms of Use shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms of Use or the Service shall be resolved through good faith negotiations between the parties.
If a dispute cannot be resolved through negotiation, both parties agree to attempt mediation before pursuing other legal remedies.

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired, and such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.

No waiver by Zarephionix of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by Zarephionix to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
20. Entire Agreement
These Terms of Use, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Zarephionix concerning the Service and supersede all prior agreements and understandings with respect to the Service.

22. Changes to Terms
